ACTION: Notice of Intent to Consider Amendments to Rule 40-12-4-.01 entitled Limitations on Noxious Weed Seeds

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. §§ 2-11-21 and 50-13-4, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments to Rule 40-12-4-.01 entitled “Limitations on Noxious Weed Seeds.” The Department will be accepting written comments from March 15, 2018, to the close of business (4:30 p.m. EST) on April 16, 2018.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES:

The Department is proposing to amend Rule 40-12-4-.01 by updating the list of prohibited noxious weed seeds in paragraph (a) and by updating the list of restricted noxious weed seeds in paragraph (b). The Department is also proposing to add a new paragraph (d) which would incorporate 7 C.F.R 360 entitled Noxious Weed Regulations, as well as all subsequent amendments and editions, by reference. Accordingly, all seed and vegetative propagules of weeds listed in 7 C.F.R. 360 would be prohibited to be intermixed or commingled with any seed covered under O.C.G.A. § 211-22.

The Department will be accepting written comments from March 15, 2018, to close of business (4:30 p.m. EST) on April 16, 2018. Comments will be considered on April 17, 2018. Please submit written comments to:
