ACTION: Notice of Intent to Consider the Adoption of Rules for the Agricultural Commodity Commission on Propane

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. § 2-8-200, notice is hereby given that the Georgia Department of Agriculture (Department) will be accepting written comments on behalf of the Agricultural Commodity Commission on Propane (Commission) regarding the adoption of Title 42 entitled Agricultural Commodity Commission for Propane. The Department will be accepting written comments on behalf of the Commission from June 26, 2020, to close of business (4:30 p.m. EST) on July 29, 2020.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES:

The Department proposes to promulgate initial rules on behalf of the Agricultural Commodity Commission on Propane regarding the Commission’s administration. These proposed rules will assist the Commission in conducting business under the statutory powers given by the Georgia General Assembly. A summarization of the proposed rules is set forth below.

    Chapter 42-1 Rules of Commission

      Subject 42-1-1 General

        Rule 42-1-1-.01 entitled Administration establishes roles associated with the administration of the Commission.

        Rule 42-1-1-.02 entitled Definitions defines key terms used throughout the proposed rules.

        Rule 42-1-1-.03 entitled Meetings establishes the rules of order for the Commission’s meetings.

        Rule 42-1-1-.04 entitled Office of the Commission establishes the address for the Commission’s office.

      Subject 42-1-2 Organization

        Rule 42-1-2-.01 entitled Creation and Structure establishes the Commission’s composition, membership requirements, and existence requirements.

        Rule 42-1-2-.02 entitled Powers establishes the Commission’s powers.

      Subject 42-1-3 Funds and Expenses

        Rule 42-1-3-.01 entitled Funds establishes powers and requirements for the handling of funds by the Commission.

        Rule 42-1-3-.02 entitled Administrative Expense Exclusions classifies certain expenditures as administrative expenses.

      Subject 42-1-4 Marketing Orders

        Rule 42-1-4-.01 entitled Issuance of Marketing Order establishes requirements for the issuance of a marketing order.

        Rule 42-1-4-.02 entitled Referendum establishes requirements regarding the Commission’s holding of a referendum.

        Rule 42-1-4-.03 entitled Opt-Out Provisions establishes opt-out requirements.

      Subject 42-1-5 Assessments

        Rule 42-1-5-.01 entitled Responsibilities of Distributors establishes responsibilities associated with the collection of assessments.

        Rule 42-1-5-.02 entitled Payment and Collection of Assessments establishes provisions for the collection of assessments.

      Subject 42-1-6 Public Hearings

        Rule 42-1-6-.01 entitled Notice of Hearing establishes the notice requirements for hearings conducted pursuant to the Commission’s authority.

        Rule 42-1-6-.02 entitled Hearing establishes the requirements for hearings conducted pursuant to the Commission’s authority.

    COMMENT PERIOD AND ADDITIONAL INFORMATION:

    The Department will be receiving written comments on behalf of the Commission from June 26, 2020, to close of business (4:30 p.m. EST) on July 29, 2020.
