Notice of Intent to Adopt Consumable Hemp Product Rule

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. § 50-13-4 and O.C.G.A. § 2-23-12, notice is hereby given that the Georgia Department of Agriculture will accept written comments regarding the proposed adoption of GA. Comp. R. & Regs. r. 40-32-5-.06 (the “Rule”). The Department will accept written comments from Thursday, August 8, 2024, until the close of business (4:30 p.m. ET) on Friday, September 6, 2024.

SYNOPSIS:

 Synopsis: 
The Department seeks to adopt the Rule to reflect the changes to the Georgia Hemp Farming Act,
O.C.G.A. § 2-23-1 et seq., made by Ga. L. 2024, SB 494.

The Rule proposes a maximum serving size and serving limit for total delta-9-THC concentration in consumable hemp products in consideration of consumer health, safety, and potential accidental misuse.

The Department expects the Rule to be effective after adoption and appropriate filing with the Georgia Secretary of State.

Proposed Adoption of GA. Comp. R. & Regs. r. 40-32-5-.06 [Serving Sizes and Serving Limits]:

 Proposed adoption of GA. Comp. R. & Regs. r. 40-32-5-.06 reflects amendments to the Georgia Hemp Farming Act in SB 494.
Proposed changes:

  • Adopt limitations on quantities of total delta-9-THC in consumable hemp products. GA. Comp. R. & Regs. r. 40-32-5-.06.

COMMENT PERIOD AND ADDITIONAL INFORMATION:

The Department will be accepting written comments from Thursday, August 8, 2024, until the close of business (4:30 p.m. ET) on Friday, September 6, 2024. Public comments and the adoption of the amended Rules will be considered at 1 p.m. on Monday, September 9, 2024, in Room 201 at the Georgia Department of Agriculture, 19 M.L.K.
