ACTION: Notice of Intent to Consider Amendments to State Warehouse Division Rules and Adoption of Temporary Grain Storage Rules

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. §§ 10-4-5 and 50-13-4, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding amendments to State Warehouse Division Rules and adoption of Temporary Grain Storage Rules. The Department will be accepting written comments from August 27, 2019, to close of business (4:30 p.m. EST) on September 30, 2019.

SYNOPSIS, MAIN FEATURES, AND DIFFERENCES:

The Department is proposing to amend current Rule 40-14-1-.02 entitled Definitions. The terms temporary grain storage unit and temporary storage will be defined, and these additions will necessitate a shift in the rule’s numbering structure. Grammatical changes will also be made to ensure consistency.

The Department is proposing to adopt Rule 40-14-4-.06 entitled Temporary Grain Storage. This proposed rule will set forward all requirements regarding the temporary storage of grain. Specifically, the rule will address the following: authorization for temporary grain storage units, authorization extensions, authorization expirations, specifications for temporary grain storage units, maintenance requirements, record management, inspections, and authorization revocation.

The Department will be accepting written comments from August 27, 2019, to close of business (4:30 p.m. EST) on September 30, 2019. Comments will be considered on October 2, 2019. Please submit written comments to:
