ACTION: Notice of Intent to Consider the Adoption of Amendments to Rule 40-4-7-.05 relating to Restrictions on the Movement of Vegetable Transplants into Georgia

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. § 50-13-4 and O.C.G.A. § 2-7-23, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments to Rule 40-4-7-.05 relating to Restrictions on the Movement of Vegetable Transplants into Georgia. The Department will be accepting written comments from August 6, 2014, to close of business (4:30 p.m. EDT) on September 8, 2014.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES:

The Department is proposing to amend Rule 40-4-7-.05 entitled “Restrictions” by removing the requirement in 40-4-7-.05(1)(a) that all vegetable transplants be treated with a “Neonicotinoid class insecticide or other” insecticide. However, under the proposed amendment to Rule 40-4-7-.05, all vegetable transplants must still be treated with an insecticide approved by the Commissioner.

The Department is also proposing to amend Rule 40-4-7-.05 by removing the requirement in 40-4-7-.05(1)(c) that any grower or seller shipping onion transplants (Alliaceae family) into Georgia provide information in writing to the Georgia Department of Agriculture in advance of shipment regarding the destination of transplants, quantity of shipment, and variety(ies) shipped.
