ACTION: Notice of Intent to Consider the Adoption of Amendments to G.A.T.E. Rules

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. § 50-13-4 and O.C.G.A. § 48-8-3.3, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments to Rules 40-29-.02 and 40-29-.03 relating to the Georgia Agriculture Tax Exemption (G.A.T.E.). The Department will be accepting written comments from September 9, 2016, to close of business (4:30 p.m. EST) on October 10, 2016.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES:

The Department is proposing to amend Rule 40-29-.02 entitled “Application for Authorization to Attain a Georgia Agriculture Tax Exemption (GATE) Certificate” by requiring that applications for the GATE Certificate be made online at www.agr.georgia.gov. The Department would no longer accept written applications, and all references to written applications would be eliminated from the Rule. Applicants would be able to contact the GATE Service Center at 855-327-6829, or 855-FarmTax, for application assistance. The proposed Rule would also provide that the application fee may be paid online, without reference to method of payment. Rule 40-29-.02 would be further amended through minor stylistic alterations in sentence structure and word choice.

The Department is also proposing to amend Rule 40-29-.03 entitled “Renewal Process” by requiring that renewals be made online. The Department would no longer accept written renewals, and all references to written renewals would be eliminated from the Rule. The proposed Rule would also provide that the renewal fee may be paid online, without reference to method of payment. Renewal assistance would be available through the GATE Service Center at 855-327-6829, or 855-FarmTax.

COMMENT PERIOD AND ADDITIONAL INFORMATION:

The Department will be accepting written comments from September 9, 2016, to close of business (4:30 p.m. EST) on October 10, 2016. Comments will be considered on October 11, 2016. Please submit written comments to:
