ACTION: Notice of Intent to Consider Amendments to the Rules relating to Bird Dealers Licensing

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. §§ 4-10-8 and 50-13-4, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments to Chapter 40-13-12 relating to Bird Dealers Licensing. The Department will be accepting written comments from August 28, 2015 to close of business (4:30 p.m. EDT) on September 28, 2015.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES

Proposed Changes to Rule 40-13-12-.01 "Definitions. Amended"

The Department is proposing to add a new Rule 40-13-12(11) to define "Exhibition Event”. An Exhibition Event is defined as a Reptile or Exotic/Pet Bird show or event that has been issued a special written permit by the State Veterinarian's office.

Proposed Changes to Rule 40-13-12-.02 "Licenses. Amended."

The Department is proposing to change the fee structure for Bird Dealer’s license fees and provide for the creation of a non-resident exhibitor’s license. The new proposed fee structure would eliminate the $50 bird dealers license defined in 40-13-12-.02 (2)(a), and replace it with a non-resident exhibitor’s license. A non-resident exhibition license will allow for bird dealers not having a permanent fixed facility in Georgia to sell birds at "Exhibition Events" only. The license will have an annual fee of $200.

Proposed Changes to Rule 40-13-12-.05 "Interstate Shipment of Birds. Amended"

The Department is proposing to add new Rule 40-13-12-.05(2) which would require that all exotic or pet birds entering Georgia for sale, trade, or exchange for a fee or other type of compensation be accompanied by a Certificate of Veterinary Inspection which has been issued within the previous 30 days and which records proof of the health requirements for each species. The remaining provisions would be renumbered accordingly.
