ACTION: Notice of Intent to Consider Amendments to Rules relating to the Georgia Animal Protection Act

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. §§ 4-11-14 and 50-13-4, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments to Chapter 40-13-13 relating to Animal Protection. The Department will be accepting written comments from August 28, 2015 to close of business (4:30 p.m. EDT) on September 28, 2015.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES

Proposed Changes to Rule 40-13-13-.01 "Definitions"

The Department is proposing to move current provision 40-13-13(34) into current provision 40-13-13(3) so that definitions and requirements for “adequate ventilation” are consolidated.

The Department is also proposing to add a new Rule 40-13-13(34) to define "Exhibition Event”. An Exhibition event will be defined as a Reptile or Exotic/Pet Bird show or event that has been issued a special written permit by the State Veterinarian's office.

Proposed Changes to Rule 40-13-13-.02 "Licenses"

The Department is proposing to change the fee structure for Pet Dealer’s licenses and provide for the creation of a “non-resident exhibitor’s license.” The new proposed fee structure would eliminate the $50 pet dealers license defined in current Rule 40-13-13-.02 (c)(1), and replace it with a fee for a “Non-resident exhibitor’s license." A Non-resident exhibition license will allow for pet dealers not having a permanent fixed facility in Georgia to participate in "Exhibition Events". The license will have an annual fee of $200.
