ACTION: Notice of Intent to Consider Amendments to Rule 40-16-1-.09 entitled “Hazardous Biologicals, Authority to Impound”
TO ALL INTERESTED PERSONS AND PARTIES:
Pursuant to the Official Code of Georgia Annotated, O.C.G.A. §§ 4-9-5 and 50-13-4, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments to Rule 40-16-1-.09 entitled “Hazardous Biologicals, Authority to Impound.” The Department will be accepting written comments from January 25, 2018, to the close of business (4:30 p.m. EST) on February 26, 2018.
SYNOPSIS, MAIN FEATURES AND DIFFERENCES:
The Department is proposing to amend Rule 40-16-1-.09 by clarifying that biologicals and test antigens such as Brucella Strain 19 vaccine, Pseudorabies vaccine, Brucella antigen, and tuberculin are restricted for sale to and use by or under direction of a veterinarian accredited by the USDA and licensed under the Georgia Veterinary Practice Act, and employees of the state and federal government approved by the State Veterinarian; provided, however, that rabies vaccine may be sold to and used by or under the direction of any veterinarian licensed under the Georgia Veterinary Practice Act and employees of the state and federal government approved by the State Veterinarian.

The Department will be accepting written comments from January 25, 2018, to close of business (4:30 p.m. EST) on February 26, 2018. Comments will be considered on February 27, 2018. Please submit written comments to:
