ACTION: Notice of Intent to Consider Adoption of Amendments to Rule 40-15-4-.02

TO ALL INTERESTED PERSONS AND PARTIES:

Pursuant to the Official Code of Georgia Annotated, O.C.G.A. §§ 10-2-5, 10-2-9 and 50-13-4, notice is hereby given that the Georgia Department of Agriculture will be accepting written comments regarding the adoption of amendments relating to weights and measures, specifically, the method of sale of nonfood products. The Department will be accepting written comments from February 9, 2015, to close of business (4:30 p.m. EST) on March 12, 2015.

SYNOPSIS, MAIN FEATURES AND DIFFERENCES:

The Department is proposing to amend Rule 40-15-4-.02 by adding a new provision (17) which will define necessary terminology and describe methods of sale for natural gas sold as a vehicle fuel. Specifically, proposed Rule 40-15-4-.02(17)(a) will define: (1.) Compressed Natural Gas (CNG); (2.) Liquefied Natural Gas (LNG); (3.) Gasoline Gallon Equivalent; and (4.) Diesel Gallon Equivalent

Furthermore, proposed Rule 40-15-4-.02(17)(b)(1) will provide that Compressed Natural Gas (CNG) kept, offered, or exposed for sale and sold at retail as a vehicle fuel shall be indicated in Gasoline Gallon Equivalent (GGE) units or Diesel Gallon Equivalent (DGE) units. Proposed Rule 40-15-4-.02(17)(b)(2) will likewise provide that all Liquefied Natural Gas (LNG) kept, offered, or exposed for sale and sold at retail as a vehicle fuel shall be indicated in Diesel Gallon Equivalent (DGE) units.

The Department will be accepting written comments from February 9, 2015, to close of business (4:30 p.m. EST) on March 12, 2015. Comments will be considered on March 13, 2015. Please submit written comments to:
