Welcome to the Georgia Department of Agriculture Legal Services’ website. The Legal Services Office provides support and assistance to the Commissioner, agency staff and management regarding enforcement of Departmental laws and regulations.
The Legal Services Office aids Department inspectors and management in enforcement actions, and reviews inspection reports, photographs and case files. This Office also drafts contracts, agreements, leases, memoranda of agreements, administrative and consent orders, and assists program divisions in the development of rules and regulations. Additionally, this Office serves as a liaison with the Georgia Department of Law, and coordinates agency work in legal proceedings litigated by the Attorney General’s office.
In 2004, the Georgia General Assembly passed O.C.G.A. § 2-2-9.1, which enabled the Department to perform in-house administrative hearings. Since that time the Legal Services Office has initiated over 700 cases involving the enforcement of the Structural Pest Control Act, the Animal Protection Act, the Humane Care for Equines Act, the Georgia Pest Control Act of 1976, Georgia Pesticide Use and Application Act of 1976, the Dead Animal Disposal Act, the Bird Dealer’s Licensing Act, the Georgia Meat Inspection Act, the Georgia Food Act, the Georgia Dairy Act of 1980, the Seed Law, the Fertilizer Act of 1997, and the Vidalia Onion Act of 1986. The attorneys for the Legal Services Office represent the Department in actions before the Department’s hearing officer.
