Notice is hereby given that the Georgia Department of Agriculture will consider the adoption of amendments to the Rules 40-13-4-.13 relating to the Contagious Equine Metritis (CEM)

TO ALL INTERESTED PERSONS AND PARTIES:

Notice is hereby given that the Georgia Department of Agriculture will consider the adoption of amendments to the Rules 40-13-4-.13 relating to the Contagious Equine Metritis (CEM) on Tuesday, October 31, 2006, between the hours of 8:00 a.m. and 12:00 noon (no hearing is scheduled), in Room 103 of the Agriculture Building, 19 Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.

SYNOPSIS, MAIN FEATRUES AND DIFFERENCES:

These rules are amended to bring 40-13-4-.13 into compliance with the Code of Federal Regulations in 9 CFR §§ 93.300-93.326.

(3) Applications (b) Removed “Revised January 1, 1999”.  The code of Federal Regulation is revised January 1 of each year.

(4) Premises (a) Inserted “Area Veterinarian in Charge” to provide for individual that could approve facility.

(b) Inserted “and agree to carry out” and “and the rules of this Chapter” to clarify the facility owner and manager’s certification.

(c) Inserted “Premises must be inspected and approved by State or Federal personnel prior to the arrival of the horses being placed in CEM quarantine” to provide inspection of premises prior to arrival of animals.

Old (4) (c) changed to (4) (d).

(4) (e) Inserted “The facility must contain stalls where individual horses can be kept separate from each other by either an empty stall, an empty area where horses cannot touch each other or by a solid wall that is at least 8 feet (2.4m)_high” to provide for separation of animals.

(4) (g) 2. Inserted “that shall not flow into areas where other horses are being maintained on the premise” to restrict drainage from the facility.
(4) (g) 4. Inserted “at the entrance of the CEM quarantine facility.  Such persons while in the quarantine facility shall wear designated coveralls and wear boots that must be disinfected with an approved disinfectant.  Footbaths must be used when entering and leaving the quarantine facility” to provide that personnel wear protective clothing and boots when entering the facility.

Old (4) (f) removed “Bio-security measures must be followed for equipment and refuse” to eliminate redundancy.

Old (4) (g) changed to (4) (h), removed rule and inserted Chapter.

Old (4) (h) changed to (4) (i).

Old (4) (i) changed to (4) (j).

(4) (k) Inserted “All horses under CEM quarantine must remain in the facility until released by the State Veterinarian” to provide for release of quarantine.

(5) (b) Inserted “Appropriate bio-security measures will be implemented between animals in the quarantine facility” to provide for bio-security between animals.

(5) (c) Inserted “All gloves, sleeves, speculums and other disposable material after each culture or treatment will be placed in plastic garbage bags and stored in the quarantine facility until it can be appropriately disposed of, or until the quarantine is released” to provide for control and disposal of all equipment and materials used in the facility.

Old (5) (b) changed to (5) (d).

(5)(d)(1) Removed “taken by an accredited and licensed veterinarian” and inserted “collected” to provide for the use of personnel other than veterinarians.

(5) (d) 3. (i) Removed “preformed by an approved veterinarian” to provide for the use of personnel other than veterinarians.

(5) (d) 4. Removed Rule and inserted Chapter.
