July 26, 2006
Notice of Intent to Consider the Adoption of Amendments to the Rules relating to the Dog and Cat Sterilization Fund, O.C.G.A §4-15-1, and Departmental Rule 40-13-14-.01.
TO ALL INTERESTED PERSONS AND PARTIES:
Notice is hereby given that the Georgia Department of Agriculture will consider the adoption of amendments to the Rules relating to the Dog and Cat Sterilization Fund on Monday, August 28, 2006, between the hours of 8:00 a.m. and 12:00 noon (no hearing is schedule), in Room 103 of the Agriculture Building, 19 Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.
SYNOPSIS, MAIN FEATURES AND DIFFERENCES:
It is proposed to amend subsection (2) of Rule 40-13-14-.01 by removing “electronic mail” as a means of requesting financial assistance from the Fund. This action is made due to the inability to manage, electronically, all submissions received.
It is further recommended to amend subsection (1) of Rule 40-13-14-.02 by changing the number of procedures performed per month per veterinarian from five (5) to three (3) in an effort to maintain operation of the Fund with a reduced level of funding.
It is further proposed to amend subsection (2) of Rule 40-13-14-.02 by adding “prior to performing additional services,” clarifying when an owner or agent must be notified of any additional charges, such as vaccinations, laboratory services, etc.
It is further proposed to amend subsection (a) of Rule 40-13-14-.02(3) by deleting “from the Dog and Cat Sterilization Fund” to avoid redundancy within the Rule.
It is further proposed to amend subsection (b) of Rule 40-13-14-.02(3) by deleting “Performed with Financial Assistance from the Dog and Cat Sterilization Fund” and “from the Dog and Cat Sterilization Fund” to avoid redundancy within the Rule. This proposed change also increases the amount of time that a veterinarian has to return a claim of payment from the Dog and Cat Sterilization Fund from thirty (30) to sixty (60) days.
