Notice of Intent to Consider the Adoption of Rules relating to Agriculture Tourist Attraction, per O.C.G.A §50-7-70.

TO ALL INTERESTED PERSONS AND PARTIES:

Notice is hereby given that the Georgia Department of Agriculture will hold a public hearing on December 22, 2008, at 1 p.m. in Room 201 of the Agriculture Building, located at 19 Martin Luther King, Jr. Drive, Atlanta, Georgia 30334.  Such hearing will be for the purpose of considering the adoption of Rules of the Department relating to “Agriculture Tourist Attractions” promulgated pursuant to O.C.G.A. §50-7-70, and established in Georgia Department of Agriculture’s rules and regulations under the new chapter 40-28 titled “Agricultural Tourist Attraction.”

SYNOPSIS AND MAIN FEATURES:

The Georgia Department of Agriculture was given the authority to create rules and regulations regarding agricultural tourist attractions.  As part of this authority, the Department was charged with determining the criteria of what constitutes an agricultural tourist attraction, the application process for registering such attractions, and the authority to maintain a registry of approved facilities. 

It is hereby proposed that facilities wishing to be designated as an agricultural tourist attraction shall make application to the Department and submit a one-time application fee of up to $250 depending on the type of agricultural tourist attraction.  The facility must certify in writing that the activity allows members of the public, for recreational, entertainment and/or education purposes, to view and enjoy agriculturally related activities.  The business must be in full compliance with all applicable state, federal and local laws, rules and ordinances. 

It is further proposed that once a facility meets the criteria constituting an agricultural tourist attraction, it will be registered as such by the Department.  The registry will include the name of the attraction, information describing the activity offered and the location.  The agricultural tourist attraction must have a point of business sign, a website, provide restroom facilities, onsite parking, drinking water and an all-weather structure.
